Temperature Nomad (“the Service”) is operated by Kelly Kuhl (“we”, “us”). By using the Service you are contracting with Kelly Kuhl and you agree to these terms. If you do not agree, please stop using the Service.

Temperature Nomad is a free, browser-based tool that converts temperatures between Celsius and Fahrenheit and expresses them as colour. Use of the converter requires no account and costs nothing. Optionally, you may send us a voluntary one-time tip (“buy me a coffee”). A tip is a gratuity; it does not purchase any feature, licence, subscription, or ongoing service, and no part of the Service is withheld from people who do not tip.

You must not misuse the Service. In particular, you must not:

  • use it for any unlawful purpose;
  • commit fraud, or submit fraudulent or stolen payment details;
  • infringe our intellectual property or anyone else’s;
  • interfere with the security or operation of the Service, including distributing malware, probing for vulnerabilities, or automated scraping.

We retain ownership of the Service and all intellectual property in it, including the software, the colour system, the artwork, the name “Temperature Nomad”, and the branding. You are granted a limited, non-exclusive, non-transferable right to use the Service for your own personal or internal business purposes. You may not reverse engineer, resell, or redistribute it.

The Service is provided “as is”. We do not guarantee it will be uninterrupted, error-free, or continuously available, and we make no guarantee about the accuracy of any conversion for a safety-critical, medical, scientific, or regulated use. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

Tips are voluntary one-time payments made to Kelly Kuhl, the seller of record. Card payments are processed securely by Stripe; we never see or store your card details. Receipts are issued by email at checkout.

Payment, billing, tax, cancellation, and refund mechanics are governed by Stripe’s consumer terms. Our own refund commitment is set out in our Refund Policy. Tips are one-time charges in US dollars; there is no recurring subscription and nothing renews automatically.

We may suspend or terminate access to the Service for material breach of these terms, non-payment or payment reversal, suspected fraud or security risk, or repeated or serious policy violations.

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the total amount you paid us in the twelve months before the claim. We exclude liability for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these terms limits liability for fraud, death, or personal injury where that limitation is not permitted by law.

You indemnify us against claims arising from your unlawful use of the Service or your breach of these terms. These terms are governed by the laws of the State of California, United States, and the courts of that jurisdiction have exclusive jurisdiction. You may not assign these terms without our consent; we may assign them in connection with a merger or acquisition. Neither party is liable for delays caused by events beyond its reasonable control. We may update these terms, and continued use of the Service after an update constitutes acceptance.
